In these regulations, the following terms will have the following meaning:
The website - the website whose address is www.sportgum.co.il
The company – Sportgum Ltd.
The products - the products that appear on the site and are offered for sale.
Delivery time - up to 7 business days from the date the order is placed: It is clarified that a business day does not include Friday or the eve of a holiday.
Delivery Day - The day on which the goods were delivered to their requested destination.
Shipping address - the address specified by the customer on the order form as the address for shipping orders.
Requested delivery date - the date specified by the customer as their preferred delivery date.
Order Placement Date - The day the transaction was approved by the customer's credit card company.

The site serves as a virtual store for selling new products and is owned and managed by the company. For any questions and/or clarifications and/or inquiries, you can contact the company's customer service directly at the company's address.
Wherever in these regulations the masculine form is used, it also refers to the feminine.
The regulations are the legal basis for browsing the site and regulate the relationship between the company and the surfer and/or the customer.
Any person who places an order and/or makes a purchase through the Site declares, by performing the action, that he has read these Terms and Conditions, and that he agrees to all the provisions and conditions of these Terms and Conditions, and that he or anyone on his behalf will not have any claim and/or demand and/or claim against the Site and/or the Company and/or the Site's management and/or the Company and/or any of its managers and/or employees, in all matters relating to the provisions and conditions of these Terms and Conditions.
The Company reserves the right to change the regulations from time to time at its sole discretion, without the need to provide prior notice and/or notification.
The product images displayed on the site are for illustrative purposes only and do not bind the site management in any way. It is clarified and agreed that the company will endeavor to do its best to present customers with images that are as accurate as possible.
Product prices include VAT according to law.
The company does not undertake to hold inventory of all models and/or products whose images appear on the site.
The Company does everything in its power to ensure that the information presented on the Site is the most complete and accurate information, however, it is clarified that inaccuracies or errors may appear therein, in good faith, and the Company will not bear any liability arising from or related to them.
The company's computer records regarding the actions carried out through the site will constitute prima facie evidence of the correctness of the actions.
Registration and placing an order
A. To place an order, the user must register on the site using the registration form. Registration is a one-time process, after which the customer will be able to order without having to register again. If you forget your password, you will send the customer a new password that will allow them to browse the site.
B. Customer details will be updated according to the data entered in the registration form.
C. Purchase of products will be made by a registered customer by filling out an order form that appears on the site. Filling in all details is a prerequisite for placing the order. In order to ensure that the order is placed quickly, efficiently and without any problems, care must be taken to provide all details accurately.
D. Immediately after execution, the company will check the credit card details and upon confirmation of the order by the credit card companies, an appropriate notification will be given to the customer stating that the transaction has been approved.
E. The details as entered in the order form, as well as the recording of the transaction in the store's computers, will constitute conclusive evidence of the correctness of the actions.
F. Submitting false information is a criminal offense and anyone who does so is subject to criminal and civil legal proceedings.
G. In the event that the transaction is not approved by the credit card company, the person performing the transaction will receive appropriate notification of this and will be required to update another payment method. In such a case, the order will not be canceled and the customer will have no claim against the company.
H. Approval of the purchase operation is conditional on the availability of the purchased product in stock on the requested delivery date and/or on the date of the order. If it is not specified that the product is not in stock and the product is not downloaded from the site by the date of the order, the site management will not be obligated to sell the product and the purchaser will not have any claim and/or claim in this regard for any direct or indirect damage caused to the purchaser or a third party. Subject to the fact that the site management will refund any amount paid (if paid) to the site management and/or cancel the charge (if made) for the purchase operation. It is clarified that there may be situations in which, although the item is displayed on the site as being in stock, in reality it is missing and cannot be supplied. In these cases, the transaction will be canceled and the customer will have no claim in this regard, subject to the refund of the amount paid by the customer.
I. Each customer will be entitled to order a product and select a new desired destination by updating the desired destination on the order form. The last destination updated by the customer will be saved in the company's database as the customer's desired destination.
J. The Company shall be entitled to not approve a customer's order for any reason whatsoever and at its sole discretion.
Advertisements on the site
A. The Company is not responsible for the content published on other sites to which there are links from the Site. However, the Company does not guarantee that the link (LINK) for each link will lead the surfer to an active website.
B. The Company will be entitled from time to time to send e-mail messages or SMS messages containing advertising, commercial announcements, etc. The user agrees that the Company has the right to send to the e-mail address that he provided upon registration on the Site messages and updates, including those that include advertising and/or commercial messages. All provided that the customer has authorized the Company to send him such advertising messages by sending an e-mail to the Company in which Hot informs him of his desire to receive such messages.
C. Upon registering on the site, the customer authorizes the company to send him direct mail with advertising content, including sending SMS messages to his mobile device at no cost to him.
D. In accordance with the Spam Law, you may choose not to receive advertising messages from the website by contacting the company's offices by telephone and/or by sending a fax and/or email.
Product return and transaction cancellation policy
A. This chapter shall be subject to the Consumer Protection Law 5741 1981 (hereinafter: the Law)
B. A customer may cancel the order in any of the following cases and under the following conditions:
1. Cancellation before the product is shipped by the company: An orderer can cancel an order for goods before they are shipped by the company, without additional charge. Upon cancellation of the order, the customer will be refunded the money he paid for it.
2. A cash credit is given for cancellations made within 48 hours of receipt of the goods. In the case of a second exchange, the customer will be responsible for shipping the product back to the company's warehouses.
After 48, no monetary credit will be given, but credit for redemption on the exchange site can be made up to 14 days from the date of receipt of the product.
C. In the event of cancellation of the transaction after the product has been sent to the customer, the customer will be credited only after receiving the goods at the company's warehouses, and this after the customer has contacted the company for the purpose of crediting the credit card with which the transaction was made.
D. As a rule, credits will be transferred only to the credit card with which the order was placed. 5% of the transaction value is non-refundable. The credit will be transferred to the buyer's credit card in accordance with the credit company's schedules. It is agreed that the customer will return the product in its original packaging, which is undamaged, intact and without damage and/or defect of any kind and type, without any use. A product that is returned and does not meet the requirements of this chapter will not entitle the customer to a refund and/or any other credit, including a credit voucher.
E. A credit will be transferred to your PayPal account if the purchase was made through PayPal.
F. If the customer does not notify the company of any defect in the product within 24 hours of receiving it, this constitutes notification that no defect has occurred and the customer and/or the ordering party will have no claim against the company and/or the website regarding the existence of any defect in the product.
G. It is clarified and agreed that a customer is not entitled to return and/or cancel/exchange two consecutive transactions unless the product has a defect that prevents him from using it. Cancellation of a transaction also includes cases of refunding money and/or granting a credit for replacing a product.
H. The Company may cancel a transaction or order in whole or in part in the following cases:
1. There was a mistake in writing, either in the product price or in the product description.
2. If it is discovered that a communication failure and/or technical problem has occurred that has prevented users of the site from using the site properly.
3. In the event of force majeure, war, hostilities, terrorism, emergency and/or anything else that prevents the proper execution of a sale.
4. The product is out of stock;
I. Notification of an order cancellation will be provided to buyers by phone and/or email to the address specified on the registration page.
J. The company and/or the site administrators will not be responsible and will not bear any direct, indirect, consequential or special damage caused to the customer and/or a third party, including financial damage due to the cancellation of the order and/or the return of the garment according to the provisions of this chapter.
K. The results of the cancellation do not detract from the company's right to claim damages due to the fact that the value of the property has decreased as a result of a significant deterioration in its condition.
12. "Direct" cardholders will receive a credit to the website, no cash credit will be possible.
13. No refund will be given for products valued at less than 50 NIS.
14. Credit/gift voucher will be valid for redemption on the website only.
- Without derogating from the generality of the foregoing and in accordance with the law, no exchange/return of a product that can be reproduced or duplicated will be possible.
- In cases of self-pickup, you can receive a cash credit within 48 hours of picking up the package from the flagship store.
Supply and delivery
A. The company undertakes to deliver the goods within the delivery time to the requested destination and will do its best to ensure that the delivery date is on the requested delivery date.
B. If the company does not deliver the goods on the requested delivery date, it will coordinate a new delivery date in advance with the customer.
C. Delivery hours are between 8:00 AM and 5:00 PM, Sunday through Thursday.
D. For Gush Dan customers with whom a time window for receiving the shipment has been coordinated: If the shipment has reached its requested destination on the coordinated delivery date and there is no presence at the requested destination, the company representative will return the goods to the company's warehouses and coordinate with the customer a new delivery date.
E. For customers outside the Dan Bloc with whom only a day without a time window is coordinated: If the shipment arrived at its requested destination on the coordinated delivery date and there was no presence at the requested destination, the courier company representative will call to set a new delivery date. In such a case, the return delivery does not involve an additional fee.
F. The new delivery time in such a case will be calculated from the date the new date is agreed upon.
G. The delivery times for products/services as shown on the sales page only include the calculation of business days (Sunday to Thursday, excluding Fridays, Saturdays and holidays).
H. The Company will not be responsible for any delay in delivering the product in the following cases:
1. Force majeure and without prejudice to the generality of the above, war, hostilities, state of emergency and natural disasters.
2. A strike by suppliers of services or goods necessary for the production, supply and/or transportation of the products.
3. Any reason beyond the control of the company.
4. A reason related to the mission operation.
Company Responsibility
A. The Company and/or the Site Management and/or anyone on their behalf will not be responsible and will not bear any direct, indirect, consequential or special damage caused to the User and/or the Surfer and/or the Orderer and/or a third party, as a result of use or purchase through the Site, not in accordance with these Terms and Conditions - whatever the reason for the notice - including loss of income and/or prevention of profit caused for any reason whatsoever, in which case the Company reserves the right to cancel the specific order.
B. If a mistake is made in the product description, this will not bind the company and/or the site management.
C. The product images on the site are intended for illustration purposes only, and there may be differences between the images displayed on the site, some or all of them, and the products actually sold.
D. In any case, the company will not bear any liability that exceeds the value of the purchased product, nor for any damage that is not direct and/or consequential damage.
E. The company is not responsible for any use made by the customer and/or the person ordering the dresses that is not in accordance with the manufacturer's and/or company's instructions, including washing and/or any other use of the dresses.
Copyright
A. All intellectual property rights, including copyrights, designs, methods and trade secrets, are the sole property of the Company. These rights apply, among other things, to the data on the Site, including the list of products, the description and design of the products and any other details related to its operation.
B. You may not copy, reproduce, distribute, sell, market, or translate any information from the site, including trademarks, images and texts, product design, product images, and the like, without obtaining the Company's prior written permission.
C. No commercial use may be made of the data published in the database, the list of products appearing therein, or other details published therein, without obtaining the prior written consent of the site management.
D. No data published may be used for presentation on the site or any other service without obtaining the prior written consent of the site management and subject to the terms of that consent (if given).
E. The name "Sportgum24" / "sportgum24t" as well as the domain name of the site, the trademarks (whether registered or not) are all the property of the company alone. They may not be used without its prior written consent.
F. To the extent that there are trademarks (including images, drawings, etc.) submitted for publication by the companies offering products and services for sale on the site, then the trademarks are the property of those companies and may not be used without their consent.
G. All verbal content, icons (ICONS), all information and/or display that appear on the site, including graphics, design, verbal presentation, trademarks, logos, including their editing and display on the site, are the exclusive property of the Company and the Company's owners.
Maintaining confidentiality
A. The company does not store credit card numbers on its computers.
B. The company takes the best precautions possible to maintain the confidentiality of information and the privacy of its customers. Data transmission on the site is encrypted using a secure SSL protocol.
C. Any transfer of a credit card number from the site to the credit card company is done encrypted using the SSL protocol. In cases beyond its control and/or arising from force majeure, the company will not be liable for any damage of any kind, indirect or direct, caused to the customer or anyone on his behalf, if this information is lost or reaches a hostile party and/or is used without authorization. The company undertakes not to use the details of the customers registered on the site except for the purposes of operating the site only, and in order to enable the order to be placed and the transfer of information to the customer.
D. Subject to the provisions of Section 4 above, the Company undertakes not to transfer customer information to a third party (other than the credit companies) without their approval.
